You agree to use the Service in a lawful manner and not for any illegal, harmful, or fraudulent activities. You are responsible for all information provided to and collected by the Service on your behalf. You must provide accurate and complete information when setting up services and maintain the confidentiality of your account credentials.

4. Payment and Billing

The Service is provided on a subscription basis and billed on a monthly cycle. All fees are due in advance of the service period. Failure to pay may result in the suspension or termination of your account. All fees are non-refundable unless otherwise specified.

5. Data and Privacy

By using the Service, you acknowledge that certain data, including call transcripts, customer information, and account details, will be collected and processed by Avares. Our handling of this data is detailed in our Privacy Policy, which is incorporated into these terms by reference. Your mobile information will not be sold or shared with third parties for promotional or marketing purposes. We implement appropriate security measures to protect your data.

6. Service Availability

We strive to provide 24/7 service availability. However, we do not guarantee uninterrupted service and may experience downtime for maintenance, updates, or unforeseen technical issues. We will make reasonable efforts to notify users of planned maintenance in advance.

7. Limitation of Liability

Avares is not liable for any direct, indirect, incidental, special, or consequential damages resulting from your use or inability to use the Service, including any missed calls, scheduling errors, or data loss. The Service is provided "as is" and "as available" without any warranties.

8. Intellectual Property

All intellectual property rights in the Service, including the AI models, software, and underlying technology, are owned by Avares. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

9. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of our services at any time. We will provide reasonable notice of significant changes that may affect your use of the services.
